Eligibility
This Contest is open only to individuals who (a) are legal residents of the United States and District of Columbia, excluding Rhode Island, and excluding areas where this Contest is prohibited, and (b) are at least eighteen (18) years of age. Affiliates of Backert Labs as well as the immediate family (spouse, parents, siblings, and children) and household members of affiliates, whether or not related, are not eligible to enter. The Contest is subject to all applicable laws and regulations.

Agreement to Official Rules
By entering the Contest, entrant indicates his/her full and unconditional agreement to, and acceptance of, (a) these Official Rules and (b) Sponsor’s decisions relating to the Contest, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Entry Period
The Contest takes place from 12:00 a.m. Eastern Time (“ET”) on Thursday, July 30, 2015 through 11:59 p.m. ET on Wednesday, September 30, 2015 (“Contest Period”). Sponsor’s computer is the official time-keeping device for the Contest.
How to Enter This Contest
To enter, send (A) your full name and (B) up to three (3) name ideas for the new Backert Labs preamp, either:

Please note: The name that Backert Labs chooses will be trademarked by, and will become the property of, Backert Labs.
Only entries that are received by Backert Labs at or before the end of the Contest Period will be considered.
Use of Your Information
Backert Labs will not disclose or show your home address or e-mail address to any other person, company or organization, and will not sell your home address or e-mail address. Backert Labs may use your e-mail address to send you periodic notices about Backert Labs products in the future. If you “unsubscribe” to any such e-mail, your e-mail address will be removed from our list and you will not receive further e-mails from Backert Labs.
Legal and Appropriate Entries Only
Limit three (3) name submissions per person/household. If an entry has more than three name ideas, only the first three will be considered. Any attempt by any entrant to submit more than three (3) proposed names by using multiple/different e-mail accounts, identities, registrations, or logins, or through any other methods, may void all of that entrant’s entries and that entrant may be disqualified. The use of any automated system to enter or subvert the entry process the Contest is prohibited and may result in disqualification.
Entries must not be inappropriate or obscene and should not violate the rights of any third party, as determined by Sponsor in its sole discretion; all such entries will be void. Sponsor reserves the right to require and/or request additional personal information to validate eligibility of any and all entrants. If you enter via your wireless phone, your wireless service provider may charge you for transmitting such data. Please consult your wireless service provider for more information. Sponsor is not responsible for any charges that a wireless service provider may charge entrant.
Winner Selection
Within 10 days after September 30, 2015, Sponsor will select a name for its new 2015 preamp, and an entry submitted that name, the person who submitted that name will be the winner of the Contest, subject to the next paragraph. The odds of winning depend on how much Sponsor likes the name or names that you submit and whether others have submitted names that Sponsor likes more, in its sole discretion.
If Backert Labs selects a name for its new preamp that was submitted by more than one entry, only one entrant will win the preamp. That winner will be determined by random drawing from those entries which submitted the name that Backert Labs chose.
If the Sponsor does not like any of the names submitted, Sponsor may choose its own name for its new preamp, in which case the prize will be awarded by random drawing from all entries received. Sponsor’s criteria for choosing the winning name will simply be the name that Sponsor likes best for its new $2,995 preamp released in 2015. Single-word entries will be favored, although a two-word name could win. Sponsor will add “1.1” to the selected name, which may change to other numerals for future versions of the preamp. Entries are welcome to include “1.1” after their suggested names; doing so will not affect their chances of winning.
Notification and Requirements of Winner
The winner will be notified by e-mail within 15 days after September 30, 2015. If the winner does not respond within 10 days after Sponsor sent the e-mail or is not in compliance with these Official Rules, he/she will forfeit the prize and Sponsor may select an alternate winner.
Prize and Approximate Retail Value
The winner will receive one free preamplifier from Backert Labs. The prize will be the new model released in 2015 and of retail value $2,995.
Taxes Arising From Winning This Contest
Winner is responsible for all federal, state and local taxes as a result of winning this Contest.
Only Warranty Is That Which Typically Accompanies The Prize
Prize is awarded “as is” with no warranty or guarantee, either express or implied, other than the warranty that usually accompanies the preamp being given away in this Contest. Prize is not transferable. All prize details will be determined by Sponsor in its sole discretion.
General Conditions
Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the Contest (or any portion thereof) in the event that the operation, security, or administration of the Contest (or any portion thereof) is impaired in any way, including, but not limited to by fraud, virus, unauthorized human intervention or other technical problem. If terminated, Sponsor may, at its discretion, award the prize at random from among all non-suspect, eligible entries received up to the time of the impairment or as otherwise deemed fair and appropriate by Sponsor. Sponsor reserves the right in its sole discretion to disqualify any individual it finds in Sponsor’s sole discretion to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner and void all associated entries. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
Release and Limitations of Liability
By participating in the Contest, entrant agrees to release and hold harmless Sponsor and its affiliates, officers, directors, employees, members, owners and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising, in whole or in part, directly or indirectly, out of participation in the Contest or receipt or use of any prize. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest. Entrant agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorneys ’ fees or other legal costs. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
This Contest shall be governed by and interpreted under the laws of Delaware without regard to its conflicts of laws provisions.
